Brand1st

Terms of sale

Effective 25 November 2026 · Version 2026-11-25

The short version. You pay once for lifetime access to Brand1st: the five stages, your Brand Master and four supplier briefs. Your answers and your Brand Master belong to you. The Triple Lock Guarantee gives you three ways to a full refund, on top of your rights under the Australian Consumer Law. If you take a founding spot, you agree to aim to lock in within 30 days, send a short testimonial, and let us publish your Brand Master as an example after you’ve seen what we plan to show.

The full terms are below. If anything here conflicts with the short version, the full terms apply.

01Who we are

Brand1st is a product of Brand1st Systems, a registered business name of Nathan Rudel, sole trader, ABN 11 454 793 177, based in Newcastle, New South Wales (“Brand1st”, “we”, “us”). You can reach us at hello@brand1st.com.au. “You” means the person buying or using Brand1st.

02What you’re buying

Brand1st is an online system for defining your brand. When you buy it, you get an account with access to:

Brand1st is a do-it-yourself tool. It doesn’t include design work (such as a logo, colour palette or website), business naming, one-on-one consulting, or legal, financial or marketing advice. Your Brand Master is built from your own answers, so its quality depends on them. We don’t promise any particular business result from using it.

Brand1st doesn’t send your answers to an artificial intelligence service. The AI Brief gives you prompts to use in AI tools of your own choosing, under those tools’ own terms.

03Price and payment

04The founding offer

The founding offer is a lower price for the first 25 buyers. It ends when 25 founding purchases have been made or at 11:59 pm (Sydney time) on 31 March 2027, whichever comes first. It won’t be extended or repeated. If more than 25 people complete a founding purchase at the same moment, we honour every completed purchase.

The founding price is offered because Brand1st is new and the founding members are its proof. When you tick the founding terms box at checkout, you agree to:

  1. Aim to lock in all five stages within 30 days of buying. This is a commitment to try, not a condition of your access. You keep lifetime access whether or not you finish in 30 days.
  2. Send a short testimonial about your experience, if you finish. It can be two or three sentences. We may publish it with your first name, business name and industry. You can ask us to leave out your name or business.
  3. Let us publish your Brand Master, or parts of it, as an example of what Brand1st produces, on our website, in emails, in ads and in sales material. Before we publish anything, we’ll show you exactly what we plan to use, and we’ll remove anything you ask us to. We won’t publish personal contact details or anything you tell us is confidential. You can withdraw this permission for future uses at any time by emailing us; material already printed or distributed may stay in circulation.

Founding members also get a short recorded video review of their finished Brand Master from Nate, the founder. It’s a one-off review, not ongoing consulting.

05Your access, and what “lifetime” means

06The Triple Lock Guarantee

The Triple Lock Guarantee is our own promise. It sits on top of your rights under the Australian Consumer Law (section 07) and never limits them.

Lock 1 · Clarity in 14 days

If you lock in Stages 01 and 02 within 14 days of buying and you don’t see your brand and your customer more clearly than the day you bought, email us within those 14 days and we’ll refund you in full.

Lock 2 · A Brand Master you’d hand over

If you lock in all five stages within 30 days of buying and you wouldn’t give your Brand Master to a designer, email it to us within those 30 days with a line on what falls short, and we’ll refund you in full.

Lock 3 · No lost work

Every answer saves to your account as you type. If Brand1st loses an answer you saved, tell us and we’ll rebuild that stage with you on a video call. This is in addition to any remedy you have under the Australian Consumer Law.

How refunds work

07Your rights under the Australian Consumer Law

The following wording is required by law and is reproduced exactly:

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Nothing in these terms excludes, restricts or modifies those rights.

08Your content

09Our content

Brand1st itself (the system, its stages, tools, wording, templates, reference material and design) belongs to us and is protected by copyright. You may use everything it generates for you in your own business. You may not copy, resell, republish or recreate the system, its worksheets or its templates, or use it to build a competing product.

10Fair use

Don’t misuse Brand1st: no attempts to break into or overload it, no automated scraping, and nothing unlawful. If you seriously or repeatedly breach these terms, we may suspend or end your access after telling you why. If we end your access without cause, we’ll refund you.

11Liability

Subject to section 07, and to the extent the law allows: Brand1st is provided for general business use, and we’re not liable for indirect or consequential loss, lost profits or business decisions you make using it. Where our liability for a failure to meet a consumer guarantee can be limited, it’s limited to supplying the service again or paying the cost of having it supplied again.

12Privacy

Our privacy policy explains what we collect and how we use it.

13Changes to these terms

We may update these terms. The version that applied when you bought still applies to that purchase, unless a change is required by law or only benefits you. We’ll show the effective date at the top of this page.

14Disputes and law

If something goes wrong, email us first and we’ll try to fix it within 10 business days. These terms are governed by the law of New South Wales, Australia. You can also contact your state or territory consumer protection agency, such as NSW Fair Trading.
